HeroShot Terms of Use
Effective date: October 26, 2026
These Terms of Use (“Terms”) are an agreement between you and HeroShot (“we”, “us”) governing your use of the HeroShot app (“the app”). By downloading or using the app, you agree to these Terms and our Privacy Policy. If you buy HeroShot Pro, our Membership Terms also apply. If you do not agree, please do not use the app.
Please read these Terms carefully, especially the sections in bold that limit our liability.
1. The app and Apple’s license
The app is licensed to you, not sold. Your use of the app is also governed by Apple’s Licensed Application End User License Agreement (“Standard EULA”). These Terms add to the Standard EULA; where the two conflict, the Standard EULA prevails. You may use the app on Apple devices that you own or control, as permitted by the App Store’s terms.
These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it.
2. Your content
You keep all rights to the screenshots, recordings and images you import (“your content”), and to the images and videos you create and export with the app. Your content is processed on your device and is not sent to us; see the Privacy Policy for details.
You are responsible for your content. Make sure you have the right to use what you import, and that what you create and publish does not infringe anyone else’s rights or break the law.
3. Built-in templates and materials
The templates, backgrounds, device models and other materials built into the app (“built-in materials”) belong to us or our licensors. You may use them as part of the images and videos you create with HeroShot, including for commercial purposes such as App Store screenshots, websites, advertising and social media.
You may not extract built-in materials and distribute, sell or license them on their own, or use them to build a competing template, mockup or design-asset product.
4. Apple trademarks and device images
Apple, iPhone, iPad, Apple Watch, App Store and iCloud are trademarks of Apple Inc. HeroShot is an independent app and is not affiliated with, sponsored by or endorsed by Apple. The devices shown in the app are illustrations. When you use them in your own materials, you are responsible for following any trademark rules that apply to you, such as Apple’s guidelines for using Apple trademarks and product images.
5. Acceptable use
You agree not to:
- copy, modify, reverse engineer or decompile the app, except where the law expressly allows it;
- remove the watermark or bypass membership checks in any way other than buying or restoring HeroShot Pro;
- use the app to create content that is unlawful, infringes the rights of others, or is meant to deceive, such as fake screens presented as genuine evidence;
- interfere with the app or with the services it relies on.
6. HeroShot Pro
Some features require HeroShot Pro, which you buy through the App Store. The Membership Terms explain the plans, billing, automatic renewal, cancellation and refunds.
7. Updates and availability
We update the app regularly and may add, change or remove features. Some features depend on Apple services such as the App Store and iCloud. We work to keep the app reliable, but we cannot promise that it will always be available or free of errors.
Your creations are stored on your device. Deleting the app deletes them unless they are synced to iCloud, so keep copies of anything important.
8. Disclaimer
To the extent permitted by law, the app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. If the app fails to conform to a warranty that applies by law, you may notify Apple, and Apple may refund the purchase price as described in the Standard EULA.
9. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits or business, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for HeroShot Pro in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer that cannot be waived.
10. Ending these Terms
You can stop using the app at any time by deleting it. If you seriously or repeatedly breach these Terms, your right to use the app ends. Sections 2 to 4 and 8 to 13 continue to apply after that.
11. Changes to these Terms
We may update these Terms. We will post the new version on this page with a new effective date and, for significant changes, also point them out in the app. If you keep using the app after the changes take effect, you accept the updated Terms.
12. Governing law and disputes
These Terms follow the same approach as Apple’s Standard EULA. They are governed by the laws of the State of California, United States, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. If you live in the European Union, Switzerland, Norway or Iceland, the laws and courts of your usual place of residence apply instead.
Wherever you live, you keep the protection of any consumer laws of your country or region that cannot be excluded by contract. If you have a concern, please email us first; most issues can be resolved quickly that way.
13. Language
These Terms are available in English and Simplified Chinese. If the versions differ, the English version prevails, unless the law where you live requires otherwise.
